In spite of it author points out some main problems in their practical using
and tries to put forward possible improvement of legal conditions (for
example new designation of operational and searching means, the new
delimitation of some aspects of the roles of prosecutors within using them,
the new legal regulation of impunity of agent, the enhancement of legal
protection of agent as confidential witness etc.).
The Chapter 8 refers to some aspects of problem of the so-called
police provocation. Author defines this provocation as an intentional,
active incitement of other persons to commit a criminal activity, which it
would not otherwise have committed and he attempts to distinguish it from
so-called “hidden reaction of police at criminal activities” in response to
started criminal activity. He concludes that using the direct police
provocation is inadmissible and forbidden by virtue of Czech law. For that
reason the final part of this chapter deals with legal regulation of so-
called “agent provocateur” in Slovakian criminal regulations.
