Summary of article: 1) Explain the difference between Actus Reus and Mens Rea.
Actus Reus means that someone did something against the Penal Code on certain time and
place and Mens Rea can be defined as the intention of this person for committing the crime.
2) Explain the elements of murder under English law.
Killing someone with a) malice aforethought, b) under the Queens peace and c) the victim
dies within a year and day.
3) Explain the difference between dealing with less serious and more serious crimes in
England.
Less serious crimes are tried in a magistrate court and the more serious one are tried in a
higher court (Crown Court) with a formal accusation.
4) What is the difference between the questions of law and the questions of fact?
The question of law deals with judge sentences or acquittal of the defendant whereas the
question of fact deals with jury and its verdict guilty or not guilty.
