Divorce:
Legally valid marriage may only be terminated by divorce.

Types of divorce:
a) fault divorce – one party blames another for the failure of their marriage
b) no-fault divorce – without assigning blame based on the ground of irreconcilable differences or incompability =
uncontested divorce, can albo be reffered as dissolution = termination of a marriage by agreement
In English law the petitioner asking for a divorce has to prove that the marriage has suffered an irretrevable breakdown
without any chance of reconciliation. The petition cannot be filled within a year after a wedding. Then there need to be
satisfactory arrangements for children and the property needs to be divided.
Proofs of irretrievable breakdown:
a) unreasonable behaviour – nepřiměřené chování – alcoholism, drug taking, gambling,
b) desertion – leaving your partner for atleast two years = not fulfilling the mutual duty of maintenance (neplnění
vzájemné manželské vyživovací péče).
c) living apart for two years plus having an agreement or living apart for five years and not having an agreement.
d) adultery was also used a lot in the past.
If spouses have a children they also have to make a satisfactory arrangements (uspokojivá opatření). They include the
question of custody (who will have the children) – the other parent must be entitled to have a contact with the children but
is also obligated to provide children with maintenance payments (výživné) in a form of either periodical payment or a
lump sum of cash.
