Definitions:
History of employment revolution:
a) before industrial revolution – virtually non-existance of employment rights, masters and servants
b) industrial revolution – trade unions – putting pressure on government to adopt some labour law (pracovní zákon) –
wages, working hours, right to strike, restriction of child labour, eight-hour workday, introduction of an insurance system
c) 20th century – increase of employment law – right to have a written statement of the main terms of the job, right to a
compensation payment when being dismissed due to redundancy, right to be given advance notice (nárok na výpovední
lhůta), right to a compensation payment (nárok na odstupné), equal opportunities policy
Termination of employment:
a) to give a notice – dát výpověď
b) to get a notice – dostat výpověď – to be dismissed – justifiable discharge: non-performance of duties – neplnění
povinností, gross misconduct, fraud in obtaining employment, disloyalty, theft, disobedience of proper directions,
incompetency – hrubé porušení kázně x wrongful discharge/unfair dismissal (nezákonné propuštění)
Employer vs. employees:
a) collective bargaining (kolektivní vyjednávání) – working hours, benefits, promotion
b) grievance procedure ( projednávání pracovních žáležitostí) – persons with a feeling of being disciplined, or discharged
without just cause
c ) strike (stávka) – industrial, picketing and strikebreaker (stávkokaz)
Fixed-term contract – it normally ends automatically on the expiration of the time or completion of the work
Permanent contract – indefinite duration of an employment contract
Gross misconduct – a very bad behaviouur of an employee, which is a fair reason for dismissal (such as drunkeness)
Collective bargaining – negotiation between an employer and a representative of a large unit of employees, to govern
hiring, work, pay and dispute solution
Picketer – a person or a group of persons stationed outsided of a place of employment, usualy during a strike, express
strike or express grievance or prevent and discourage entry by non-striking employeees or customers
