a) negligence – failure to follow a certain degree of care owed to plaintiff. A duty of care needs to exist, it needs to be
breached and there needs to be a proximate cause (příčinná souvislost).
b) malpractice – negligence committed by a professional, it is a failure to provide reasonable care (přiměřená péče).

Liability:
Strict (responsibility for injury even if it wasn't intended) x vicarious (liability for the acts of employees)
Objective (without fault) x subjective (with fault)

a) freehold – svobodná držba - a freeholder is the absolute owner of the land, he possesses the land untill he dies and then
the land is passed to his heirs
Freeholder = owner = landlord (pán domácí) = lessor (pronajímatel)
Fee simple (bez podmínek) x fee tail (za určitých podmínek)
b) leasehold – pronájem - a leaseholder is someone who is renting the land, he possesses the land for a certain period of
time
Leaseholder = tenant = lessee (nájemník)
