It protects the way the idea is expressed, not the idea itself. Unregistered right arises as soon as something is created. The
owner has the right to reproduce the work, prepare derivative works, distribute copie and perform the work publicly. The
owner has the right to seek damages, injunction or seizure of illicit recordings.
Extended copyright protection – applies to material sent over internet.
There are also neighbouring rights (práva bezprostředně příbuzející s autorským právem) which are provided to
performing artists, producers of sound recordings and broadcasting organizations.
Copyright groups:
a) literary, dramatic, musical and artistic works
b) sound recordings, films and broadcasts
c) typographical arrangements of published editions
Patent:
It gives the right to the inventor and empowers owner to take legal action. It protects inventions, procedures and
processes. For patent to be granted, the object needs to be new, it needs to involve an innovative step and should be
capable of industrial application. It is a property right granted to the inventor (patentee) by the patent office (patentor). Its
meaning is to deter a potentional infringer (neoprávněný uživatel).
Types of patents:
a) utility patents (užitné vzory)
b) designs patents (průmyslové vzory)
c) plant patents (ochrana práv k novým odrůdám rostlin a plemenům zvířat)
