Definitions:
Civil procedure (občanské právo procesní) can be understood as the body of law that sets out the rules and standars that
courts follow during a trial.
Parties:
Plaintiff/claimant/petitioner (navrhovatel) x defendant/respondent (odpůrce). Petitioner and respondent are used only in
family law.
Stages in civil procedure:
a) the plaintiff files a complaint with the court (žaloba).
b) the court issues and serves a writ of summons on the defendant (soudní obsílka) with a notice of the lawsuit (oznámení
o žalobě)
c) the defendant confirms by filling acknowledgment of service (potrvrzení o převzetí soudní obsílky) and is required to
serve a defence/an answer (vyjádření k žalobě). He can also file a counterclaim.
d) the plaintiff files a reply as an answer to the defense or counterclaim.
e) the litigants can reach out of court settlement (mimosoudní dohoda/uzavření smíru) or the case goes to a trial.

INTRODUCTION TO LAW
Descriptive law describes how something behaves (laws of gravitation), whereas prescriptive law prescribes how people
should behave (speed limit).
Informal rules are the rules of the society (we may face criticism or throwing objects by disobeying them), more formal are
the rules of institutions (suspension, expulsion) and formal laws are formed by the state and disobeying leads to an action.
