DEFINITIONS

crime - act which the state considers to be wrong and which can be punished by the state

Actus Reus - the criminal act itself

Mens Rea - the criminal state of mind of the person when he committed the act

duress – it is one possible type of defence

defense – it exempts a person from criminal liability

mitigation – making the punishment not so harsh

Question of law – the judge is in charge

Question of fact – the jury is in charge and gives verdict (guilty or not guilty)

Two elements of crime – These are Actus reus and Mens rea. It can be explained as 1. criminal act itself and 2. the criminal state of mind of the person when he committed the act. Mens rea usually means, that the criminal intended to commit crime. Actus reus means that he really comitted the crime.

Defenses – Defenses are some reasons, which can lead court to found defendant not guilty. One of defense is duress – being forced to commit crime because of threats that you or someone else will be harmed if you don’t. Other is insanity. Person cannot be found guilty, if doctor says he can’t be responsible for his actions because of mental illness. Other defense is intoxication. There is usually missing mens rea, but if the person is intoxicated knowingly, he is responsible for his actions. The last is self-defense. Defendant must prove, that the force he used was reasonable to protect himself.
