DIVORCE – if I want to get divorce I must petition for it 

-  parties to a divorce: 

o 

petitioner – navrhovatel, žadatel 

o 

respondent – odpůrce 

-  to petition for divorce – zažádat o rozvod 

-  divorce is granted – rozvod je povolen, přípustný 
-  divorce is granted if petitioner has convinced the court that the marriage has broken 

down irretrievably – rozvod je povolen pokud navrhovatel přesvědčí soud, že 
manželství se nenapravitelně rozpadlo 

-  reconciliation = smíření při řízení 

3 steps for divorce: 

1.  Petitioner has to prove the reasons (proving irretrievable break down of the marriage 

without any chance of reconciliation – prokázání nenapravitelného rozpadu manželství 
bez možnosti usmíření) 

  adultery – cizoložství 
  unreasonable behavior – e.g. gambling, alcoholism, domestic violence (domácí 

násílí) 

  desertion (one of partners has deserted other spouse for 2 years) – zanedbání 

vyživovací povinnosti 

  living apart for 2 years + agreement 
  living apart for 5 years 

2.  Making satisfactory arrangements for children 
-  3 things must be solved: 

  determining custody – who will take care of the children 
  determining contact (GB) or visitation rights (US) 
  determining the maintenance payments – stanovení výživného –2 forms:

o 

periodical payment – pravidelné poplatky

lump sum of cash – jednorázově paušálem

3.  Dividing property-  2 kinds of property in marriage:

o 

community property – společné jmění manželů

o 

separate property – majetek ve výlučném vlastnictví jednoho z manželů – it may 

be gained:

by gift - darováním

by inheritance – dědictvím

Může ti to být odkázáno. – It may be bequeathed to you.  

rozvodové řízení – divorce procedure, divorce proceeding
