Structure of case brief (soudní spis)
Name of the case- who is opposing whom, with the name of the party who initiated legal action appearing
first
Facts of the case (skutková podstata případu)- a summary of the relevant facts, the nature of the
litigation, what happened in the lower court(s)
Legal issues (právní otázky) - questions of law raised by the facts specific to the case, often phrased in
terms of questions that can be answered with “yes” or “no” (or in the form of an indirect question
beginning with “whether”)
Holdings - the court’s answer to a question presented can include narrow procedural holdings such as
“case reversed and remanded”
Reasoning - the chain of arguments which led the judges to rule as they did

Annulment (zrušení od počátku) – marriage as if it has never existed
Joint custody (společná péče) - an arrangement whereby both parents have legal custody and/or both
parents have physical custody
Sole custody (výlučná péče) - a traditional form of custody, an arrangement whereby only one parent has
physical and legal custody of a child
Bird's nest custody (střídavá péče, jezdí rodiče) - an arrangement when children are in one place and
parents change at home
Third-party custody (pěstounská/poručenecká péče) - an arrangement in whereby the children do not
remain with either biological parent, and are placed under the custody of a third person
Split custody (každé z dětí je výlučně u jednoho z rodičů) - an arrangement whereby one parent has full
time custody over some children, and the other parent has full custody over the other children
Desertion (zanedbání povinné výživy) - having left your partner for at least two years previously
