A LEASEHOLD
- a leaseholder is somebody renting the land, he possesses the land for certain period of
time
- LEASEHOLDER = TENANT = LESSEE – nájemník, nájemce
- duties of a leaseholder:
o
paying rent (ground rent)
o
keeping buildings in a good condition
- rights of a leaseholder:
o
to possess the land the right to exclusive possession – tzn. no one can enter
the land even the landlord
o
to sell the right to use the land to sell his lease to a third party (= remainder of
it)
- if a leaseholder doesn’t pay rent, the lease could be ended = FORFEITED – pokud
nájemce neplatí nájem, držba “lease” může být ukončena
However, the freeholder has to warn the leaseholder and give him a certain period of
time to pay his rent arrears. If not – then it may be forfeited.
heirs – dědicové
covenants = obligations, which the leaseholder and freeholder owe to each other
exclusive possession – výlučné vlastnictví
to be forfeited – být ukončeno
right to possess land – právo mít nemovitost v držení…proč pouze v držení a ne vlastnictví?

ground rent – nájem, nájemné
legal interests – věcná práva k věci cizí

right to entry – právo ujmout se držby (if a lessee fails to pay rent, a freeholder can enter a
property)
